These terms and conditions ("Terms") govern your use of the www.lady-luxe.com ("Lady Luxe") online store. By placing an order through Lady Luxe, you express your understanding and agreement that you are bound by these Terms. If you are unwilling to be bound by these Terms, you should not use the Lady Luxe online store.

Order Validation and Acceptance
Once you have finalised the placement of your order with Lady Luxe you have agreed to pay for the items you have purchased. If you are purchasing via other method (Direct Deposit/Cheque/Money Order) Lady Luxe must receive payment within seven (7) business days of the transaction taking place. If no payment is received within this timeframe Lady Luxe reserve the right to pursue you legally for money outstanding with all legal costs to be paid by you, the debtor.

When you place an order through Lady Luxe, we may verify your method of payment and your shipping address before processing your order. Your placement of an order via Lady Luxe online store is an offer to purchase our products. Lady Luxe may accept your order by processing your payment and shipping the product, or may, for any reason, decline to accept your order or any part of your order. No order shall be considered to be accepted by Lady Luxe until the product has been shipped. If we decline to accept your order, we will attempt to notify you using the email address you provided to us with your order.

Quantity Limitations
Lady Luxe may limit or cancel quantities available for purchase on any order on any basis, and alter the availability or duration of any special offers at any time. Lady Luxe may reject any order, or any part of any order.

Electronic Communication
When you place an order through the Lady Luxe online store, you are required to provide a valid email address, which we may use to communicate with you regarding the status of your order, advise you regarding shipment, and to provide you with any other notices, disclosures or other communications relating to your order. You agree that Lady Luxe will not be responsible for any damage you incur, or information you do not receive, as a result of your failure to provide a valid email address.

Product Display/Colours Lady Luxe attempts to display as accurately as possible the colours of the products shown on the website. However, because the colours you see will depend on many factors, including your monitor or printer, Lady Luxe cannot guarantee that the colour you see on the website matches the product colour exactly.

Pricing and Product Information
Lady Luxe makes every effort to provide current and accurate information relating to products, services, and prices displayed on the website, but does not guarantee the currency or accuracy of any such information. Information relating to Lady Luxe's products is subject to change without notice. Prices are subject to change at any time prior to Lady Luxe's acceptance of your order. In the event we discover a material error in the description or availability of a product or service that affects your outstanding order with Lady Luxe, or an error in pricing, we will notify you of the corrected version, and you may choose to accept the corrected version, or cancel the order. If you choose to cancel the order, and your payment has already been processed for a purchase, Lady Luxe will issue a credit to your nominated account in the amount of the charge.

Security and Privacy
The Lady Luxe online store follows the industry standard, Secure Sockets Layer ("SSL"), for the transfer of sensitive data over the internet. When entering your credit card number online, a lock icon will appear in the bottom right of your browser window. This icon is your confirmation that SSL has been activated for the transfer of your personal information. A second indication of SSL activation is that the displayed URL will begin with "https."

Payment and Shipment
In most cases, you will not be charged if Lady Luxe declines to accept your order. If you have been charged, Lady Luxe will process a refund.
In the event your shipment will be delayed more than fourteen (14) days after the recommended date of delivery of your order, Lady Luxe will attempt to notify you by email, using the email address you provided with your order, and you may elect to cancel the order. If you elect to cancel the order, Lady Luxe will issue a refund.

Shipping and Handling
All orders placed on Lady Luxe in stock items are generally shipped within 24 hours of receipt of payment into Lady Luxe's account, Monday through Friday, and arrive within 2-5 working days depending on your selected method of postage. If you pay by direct deposit, cheque or money order we will not post your order until payment has cleared. Lady Luxe do not ship on Saturday, Sunday or on National Public Holidays.
All orders placed on Lady Luxe out of stock items will be posted once the item is in stock. Generally you will receive this item within four (4) weeks. Lady Luxe will process payment upon receiving your order and will notify you of the expected postage date. We will not post your order until receipt of your payment is in Lady Luxe's account.

Goods and Services Tax
Lady Luxe collects and remits GST taxes as required by Australian law on purchases (and shipping) made via the online store.

Refunds, Returns and Exchanges
Lady Luxe advises that due to the personal and delicate nature of our products we are unable to offer a refund unless the product is faulty. Please choose carefully before you purchase.

If you believe that you have received a faulty item, please contact us via email an accurate description of the fault (using the subject line: Exchange - Faulty Goods) within (5) days from the date of receipt and you will be sent a reply containing an exchange authorisation number and instructions on returning the item.

Lady Luxe will not exchange a faulty item that is not in its original condition, had its tags removed, been washed, soiled, worn or damaged.

Please note that items returned for exchange will not be accepted without an exchange authorisation number.

Sizing
Lady Luxe have made every attempt to represent the correct sizing of items please confirm you are ordering the correct size by checking our sizing chart for the correct brand before purchase.

Due to the personal and delicate nature of our products we are unable to provide a refund for incorrect sizing, therefore it is imperative that you confirm you are ordering the correct size.

If you believe we have made an error in labelling the sizing of one of our products please email us (using the subject line: Incorrect Sizing) within five (5) days from the date of receipt and you will be contacted to further discuss your query.

Your Acceptance of this Condition of Use
By using Lady Luxe's online store, you signify your acceptance of these terms and conditions. If you do not agree to these terms and conditions, please do not use Lady Luxe's online store. We reserve the right, at our discretion, to change, modify, add or remove portions of these terms and conditions at any time, so visitors are encouraged to review them from time to time. Your continued use of the Lady Luxe online store following the posting of changes to these terms and conditions means you accept these changes.
